Welcome to Roost. These Terms of Service ("Terms") govern your use of the Roost website, mobile applications, and related services (collectively, the "Service"). By accessing or using Roost, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.
Acceptance of Terms
By creating an account, accessing, or using Roost, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Roost. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Description of Service
Roost is a household management platform designed to help people living together coordinate their shared lives. Our Service includes tools for:
- Splitting and tracking household expenses
- Managing shared grocery lists and household supplies
- Assigning and tracking chores and responsibilities
- Scheduling and calendar coordination
- Maintenance reminders and household planning
- Communication and activity tracking within households
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when practicable.
Account Registration
To use Roost, you must create an account. By registering, you agree to the following:
- Accurate Information: You must provide accurate, current, and complete information during registration and keep your account details up to date.
- Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
- Age Requirement: You must be at least 18 years old to create an account. Users between 13 and 18 may use the Service only with the consent and supervision of a parent or legal guardian.
- One Account Per Person: Each individual may maintain only one Roost account. You may not create accounts using automated means or under false pretenses.
Acceptable Use
You agree to use Roost responsibly and in compliance with all applicable laws. You agree not to:
- Use the Service for any unlawful purpose or to promote illegal activities.
- Harass, threaten, intimidate, or bully other users.
- Impersonate another person or misrepresent your identity or affiliation.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service, other user accounts, or computer systems.
- Upload, post, or transmit malicious code, viruses, or harmful content.
- Use automated tools (bots, scrapers, etc.) to access the Service without our written permission.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to send spam, unsolicited messages, or promotional material without consent.
User Content
You retain ownership of all content you create and submit to Roost, including household data, expense records, notes, and preferences ("User Content"). By using the Service, you grant Roost a limited, non-exclusive, worldwide, royalty-free license to:
- Store, process, and display your User Content as necessary to provide the Service.
- Share your User Content with other members of your household as directed by you.
- Use aggregated, anonymized data derived from your User Content for analytics and service improvement.
You are solely responsible for your User Content and represent that you have the right to submit it to the Service. We reserve the right to remove content that violates these Terms.
Subscription & Payments
Roost offers both free and paid subscription plans. The following terms apply to paid plans:
- Pricing: Current pricing is listed on our Pricing page. We reserve the right to change pricing with 30 days' advance notice.
- Billing: Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
- Auto-Renewal: Subscriptions auto-renew at the end of each billing cycle (monthly or annually) unless you cancel before the renewal date.
- Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, your plan will revert to the Free tier at the end of your current billing period. No partial refunds are provided for unused time in a billing cycle.
- Free Trial: If you sign up for a free trial, you will not be charged until the trial ends. You must cancel before the trial expires to avoid charges.
- Refunds: We offer refunds on a case-by-case basis. If you believe you've been charged in error, please contact us at legal@roost.app within 30 days of the charge.
Intellectual Property
The Roost name, logo, website, application, and all associated designs, graphics, code, and content are the intellectual property of Roost and are protected by copyright, trademark, and other intellectual property laws. You may not:
- Use the Roost name, logo, or branding without our prior written consent.
- Copy, modify, or distribute any part of the Service for commercial purposes.
- Remove, alter, or obscure any proprietary notices on the Service.
We welcome feedback and suggestions but note that any ideas you submit may be used without compensation or obligation to you.
Limitation of Liability
To the fullest extent permitted by law:
- Roost is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
- In no event shall Roost, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
- Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
We reserve the right to suspend or terminate your account under the following circumstances:
- For Cause: We may suspend or terminate your account immediately if you violate these Terms, engage in harmful conduct, or use the Service in a way that could damage or impair our systems or other users' experience.
- At Your Request: You may delete your account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
- Without Cause: We may discontinue the Service or terminate accounts with 30 days' advance notice.
Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including intellectual property, limitation of liability, and dispute resolution clauses.
Dispute Resolution
We want to resolve issues quickly and fairly. If a dispute arises:
- Informal Resolution: You agree to first attempt to resolve any dispute by contacting us at legal@roost.app. We will make a good-faith effort to resolve the matter within 30 days.
- Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
- Arbitration: If we cannot resolve the dispute informally, you agree that any claim will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis — class arbitrations and class actions are not permitted.
- Statute of Limitations: You must bring any claims within one (1) year from the date the claim arose.
Changes to These Terms
We may update these Terms from time to time. When we make changes:
- We will post the updated Terms on this page with a revised "Last updated" date.
- We will notify you via email for material changes, with at least 15 days' advance notice before the changes take effect.
- Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
- If you do not agree with the updated Terms, you may terminate your account before the changes take effect.
